Poor Riley Gaines, a young woman who had a stellar collegiate swimming career at the University of Kentucky only to have 6’4” transgender Lia Thomas foisted on her and all the other women in NCAA swimming competition. In an August 5th, 2023 NY Post article by Dana Kennedy summarizing an interview with Bill Maher, Gaines recounted how the NCAA had given Thomas, and all transgender women, free access to the women’s locker rooms. 

It’s not hard to imagine what happens next (unless you’re a college administrator or work for the NCAA).  Gaines tied Thomas in the 2022 NCAA Championships and since has become an outspoken activist against biological men in women’s sports – saying it was unfair and that changing alongside Thomas in the locker room was weird and awkward. Some swimmers undressed in the janitor’s closet to avoid Thomas. “That was a situation I tried to refrain from looking at entirely,” Gaines said, according to a transcript of the Club Random podcast. “We can’t unsee it. Being in that space with a male, it’s like a bad car wreck.”“6-foot-4 male. Use your imagination,” she said. By the conclusion of Thomas’s swimming career at UPenn in 2022, Thomas’ rank skyrocketed from 65th for men to 1st in the female 500-yard freestyle, and from 554th for men to 5th for women in the 200-yard freestyle. Those results make it hard to argue that biological men competing as transgender women have an advantage.

What is biological gender, gender assigned at birth and gender identity, you say?  Afterall there are only two sets of chromosomes XX and XY and they determine our biological gender. CNN reporter Devan Cole wrote that "It's not possible to know a person's gender identity at birth, and there is no consensus criteria for assigning sex at birth." No consensus? For millennia doctors only had to look below the waist to make that determination. But don’t worry, if your doctor can’t determine gender at birth (you need a new doctor) he or she can assign you one, presumably by looking below the waist. Like most liberal policy, something they intended for good (accepting individuals with real gender dysphoria issues) has morphed into a bizarre theater of the absurd, while forcing biological women to dress, shower, and compete against biological men who “feel like a woman”.


Confused? Good, so am I. This ridiculous word game has the potential to cause grave injury like getting a volleyball spiked to your head by a 6’4” 240lb female volley ball player. Let’s take a moment to review some of the more common pronouns and you’ll see how their use simplifies the matter.


Ze, zem, zir These are alternative gender-neutral pronouns that have been proposed and used, especially in LGBTQ+ communities. Ze is a gender-neutral pronoun, pronounced like "zee" while Zem is the objective case (like "him/her") and Zir is the possessive case (like "his/her"). These pronouns are used as alternatives to he, him, his or she, her, hers. Ok, that’s enough. Just remember, when you are reading an article about someone who identifies as a Zir and the article constantly refers to “they” that could be “him” or it could be “them”


Perhaps this is a good time to discuss Natural laws. Natural Laws are fundamental principles that describe and govern the behavior of the natural world. They are derived from observations of nature and are believed to be universal and constant across time and space. Natural laws are:

1. Universal principles that apply throughout the universe.

2. Derived from nature rather than human-made rules or societal conventions.

3. Discovered through observation and scientific inquiry, not created by legislation.

4. Constant and unchanging, regardless of time, place, or cultural context.


There are two main philosophical views on natural laws. Regularity Theory holds that natural laws are simply descriptions of uniformities or regularities observed in the world.


The Necessitarian Theory perspective argues that natural laws are governing principles that the natural world must obey. We have no choice, they are not man-made, they are just how nature works. Natural laws are found across various scientific disciplines For example in physics we don’t challenge Newton’s law of universal gravitation. I can no sooner say that I am not going to observe gravity today any more than I can say I’m going to walk to the moon. We have laws of thermodynamics, laws in chemistry e.g. The conservation of matter and biology like Mendel’s laws of inheritance which states the fundamental principles of genetics that describe how traits are passed from parents to offspring.


So what am I to make of the notion that there are 57 genders (pick a number, any number other than 2!) Perhaps Websters dictionary was just ill-informed. In 1957, the year I was born, Noah Webster defined Gender as follows: GEN'DER, noun [Latin genus, from geno, gigno; Gr.to beget, or to be born; Eng. kind. Gr. a woman, a wife; Sans. gena, a wife, and genaga, a father. We have begin from the same root. See Begin and Can.]

1. Properly, kind; sort.

2. A sex, male or female. Hence,

3. In grammar, a difference in words to express distinction of sex; usually a difference of termination in nouns, adjectives and participles, to express the distinction of male and female.


There are differing perspectives on how gender relates to natural law. The traditional natural law view sees biological sex as binary (male/female) and determined by nature/God. This view sees gender as intrinsically linked to biological sex and considers transgender identities as going against the natural order while contemporary perspectives believe gender as a social construct distinct from biological sex and sees gender identity as more fluid and not necessarily tied to sex assigned at birth. Some argue natural law should evolve to recognize lived experiences of transgender individuals.


But wait, isn’t the definition of natural law in part a law that is both derived from nature rather than human-made rules or societal conventions (that would be XX/XY) and is immutable? Aren’t Natural Laws discovered through observation and scientific inquiry, not created by legislation? Wait, isn’t all this gender discussion legislated by progressive politics and a compliant media? 


Of course, natural law is constant and unchanging, regardless of time, place, or cultural context. So how is any of this real. Well, gender dysphoria is real, what does not seem real is the way progressives have chosen to deal with it. Sure, don’t feel comfortable in your own skin at the age of 12 (who does?) well, we can surgically mutilate you so you no longer have the sexual organ you were born with, we can ply you with hormone blockers that will have you jumping out of your skin, not knowing what skin you belong in. You see…just because you CAN do something does not mean you SHOULD do something. At least that something that allows one to mutilate a 12-year-old child!


Scientific understanding of sex and gender has “evolved” but natural law is unchanging so those that argue gender identity like all natural laws should evolve, might just be walking to the moon as we speak.
